Abstract

Since Islamic law is a complete system and has assigned rules to solve human problems and control all aspects of their lives. Therefore, we can clearly say that no problems or happenings occur in human life unless Islamic law identifies the main cause of each phenomenon and shows solutions to overcome that problem. Therefore, one of the issues and cases that are being involved in Taleghan-Takhar-Afghanistan is the issue of factors that increase divorce. And this issue is one of the important and fundamental issues, and there are numerous factors involved in its increase. This article has two parts, the first part is focused on reviewing related library literatures. In this part the most important factor in increasing the rate of divorce from the perspective of Islamic jurisprudence is unhealthy choices, social class differences, addiction, economic problems, inadequacy of couples, and other issues, each of which plays a significant role in the increase of divorce and generates negative effects in society. In the second part, a questionnaire was distributed to one hundred university professors, students, and relevant departments (Takhar Province Court and Judiciary) and was reviewed. The respected respondents provided accurate information, and the answer to each question was drawn in a separate table and a specific graph. The most important factors that respondents emphasize are: Underage marriages, poverty, family interference, family violence, illegal relations between men and women after marriage, forced marriage, economic problems, drunkenness and addiction, ignorance of the ugly consequences of divorce, desire and remarriage, cultural and class differences, misunderstandings and miscommunications, husbands' absence, mental illnesses, inadequacies of couples, and ultimately, lack of awareness of Sharia and Islamic rights.
